Divorce — The Basics

What is an uncontested divorce?
It's when both spouses agree on the divorce and all terms (custody, property, debts). Fastest and cheapest process. In Florida, typically resolved in 30-45 days.
How long does divorce take in Florida?
Uncontested divorce with mutual agreement: 30-45 days. Divorce by summons (spouse doesn't respond): 60-90 days. Divorce by publication (missing spouse): 90-120 days.
Do I have to go to court?
No. For uncontested divorces in Florida, our team handles the entire process. You don't appear in court.
What documents do I need to start?
Photo ID, marriage certificate, basic spouse info (name, address, date of birth). If you have children: their birth dates. If you have property: estimated values.
Can I divorce if my spouse is out of state or country?
Yes. If one of you has lived in Florida at least 6 months, you can file here. If the spouse is out of state, we use service by summons or publication depending on the case.
Do you work all of Florida or just Miami?
All of Florida. We handle cases in all 67 counties from Miami to Jacksonville, Pensacola to Key West.

The Process Step by Step

What is a Marital Settlement Agreement?
The document where both spouses agree on how to divide property, debts, and (if applicable) custody/support. Required for all uncontested divorces in Florida.
What is a Parenting Plan?
The legal plan detailing custody, parenting time, child support, and major decisions about the children. Required when there are children under 18.
What if my spouse doesn't agree or doesn't respond?
We can still help. We handle "Divorce by Summons" when your spouse doesn't respond, and "Divorce by Publication" when they can't be located.
How is child support calculated?
Florida uses a state formula based on combined parental income, parenting time, childcare expenses, and health insurance.
Can I change my last name during divorce?
Yes. In the divorce you can request restoration of your maiden name or any prior name. It's a simple check-box on the documents.
